TERMS OF USE
1. GENERAL REGULATIONS
STARA PELEGRINKA, sports and recreation association, Sinovčićeva 6, 21 000, Split, personal identification number (PID): 61924237066 (hereinafter Stara Pelegrinka) is the owner of the Smart Training website, web application, Android and iOS applications (hereinafter referred to as the Platform).
The Smart Training web application, Android and iOS applications form a system that allows its users to purchase exercise programs, monitor training schedules and create their own exercises and programs. With the Smart Training web application, trainers can connect with their clients and assign personalized training sessions.
The platform distinguishes between two types of users (hereinafter collectively referred to as User):
I. Coach – a user who creates exercise programs
II. Athlete - a user for whom the Trainer creates exercise programs or who buys programs in the store
III. Partner – a user who can create exercise programs and publish them in the store
The terms of use regulate the conditions and rules for users, and refer to the regulation of the way of using the Platform. Read them carefully.
By using the Smart Training website or any other service, product or information of the Platform, the User accepts all orders and terms of use stated on this page. The user also accepts all risks arising from the use and accepts the use of the Platform only for personal use and at his own risk.
Stara Pelegrinka reserves the right to change or terminate any segment of the business at any time, including without limitation the content, time availability, as well as the equipment required to access or use the pages. Moreover, Stara Pelegrinka may stop sending any part of the information, or any type of information, may change or cancel any method of data transmission, may change the speed of data transmission as well as any other characteristics.
2. USER ACCOUNT
The use of the platform is permitted only to persons over 18 years of age. The User personally declares and guarantees that he is over 18 years old when accessing, using or registering on the Platform.
The User must have a user account as well as a profile on the Platform in order to be able to use the Platform.
The user undertakes to submit correct and true data and, if necessary, to update them on his profile in order to guarantee the relevance and accuracy of the data.
Stara Pelegrinka does not guarantee the accuracy, reliability or content of any information, exercise program or training published on the Platform, and reserves the right to change, adapt, exchange, delete or remove any content it deems inappropriate.
By creating a user account, the User grants Stara Pelegrinka the right to publish a basic set of information within the Platform, where other Users can see the given information, for the purpose of connecting the User and sending or publishing the program.
In order to successfully complete the registration, the User must read and accept the Terms of Use and the Privacy Policy. By accepting the General Terms and Conditions, the User declares that all information about him is true and correct.
The user can terminate the contract with Stara Pelegrinka at any time, without any costs and without giving reasons, with prior settlement of all obligations incurred during the duration of the contract.
In case of violation of the regulations specified in the Terms of Use and the contract or if Stara Pelegrinka has a real reason to believe that it needs to protect its safety and integrity, the safety and integrity of the User or third parties, or in order to prevent fraud or for the purpose of investigation, Stara Pelegrinka retains the right to limit the access of the User who violates them, to temporarily or permanently suspend the user account of the User who violates them, or to terminate these rules and conditions of use that obligate you to Stara Pelegrinka, immediately and without prior notice.
3. RESPONSIBILITY AND CONDUCT OF THE USER
All interpersonal communication and interaction that takes place through the Platform should be in accordance with these General Terms and Conditions of Business and Use. Users may not publish or transmit through the Platform any materials that threaten or in any other way violate the rights of others, any materials that are by their nature illegal, threatening, offensive, defamatory, disturbing or threatening privacy, vulgar, obscene or is otherwise objectionable in appropriate communication, encourages illegal activity or otherwise violates any regulation.
Any type of verbal, physical, written or any other inappropriate communication and behavior of the User towards any other User, employee and/or associate of Stara Pelegrinka will result in immediate termination of cooperation and deactivation of the user account.
The user himself is responsible for compliance with all laws, regulations and obligations that apply to his use of the Platform.
Stara Pelegrinka is not one of the contracting parties of any agreement, contract or contractual relationship of any kind that is concluded between Platform Users.
Stara Pelegrinka disclaims all responsibility for any User's actions related to the use of the Platform, as well as for any damage or any other type of direct or indirect loss, which may occur to the User or any third party as a result of:
I. use of the Platform
II. impossibility of using the Platform due to unprofessional behavior of the User
III. unavailability of the Platform as a result of technical problems or force majeure
IV. errors in the operation of the Platform
Stara Pelegrinka is not liable to the User for damage caused by misuse of the Platform, especially when the misuse is caused by force majeure, equipment failure, poor handling, the influence of other licensed or unlicensed computer programs, viruses or other harmful effects.
Stara Pelegrinka reserves the right to change the terms of use at any time and is not responsible for possible consequences that may arise from such changes. These changes come into effect upon publication on these pages or when users are notified of them. The amended terms of use apply to all existing and future users.
4. INTELLECTUAL PROPERTY
Platformcontains material protected by copyright, material protected by a trademark, design and other information that is covered by other rights of natural or legal persons, including, but not limited to, texts, photos, graphics, as well as all content of the Platform, and according to the regulations of the Republic of Croatia. The user may not modify, publish, transfer, participate in the transfer or sale, create derivatives or in any other way exploit any content, in whole or in part. The user may download, print and save copyrighted materials for personal use only. Copying, redistribution, rebroadcasting, publication or commercial exploitation of the downloaded material is not permitted without the express written permission of Stara Pelegrinka and the copyright holder.
5. OBJECTION
Every User has the right to submit a written complaint in case of dissatisfaction with the Platform or any other service provided by Stara Pelegrinka.
To be valid, the complaint must contain: User's first and last name, phone number, email address and description of the problem/reason for the complaint.
Submitting a written complaint is possible via e-mail: smart.training01cro@gmail.com. Smart Training will respond to the User's written complaint within the legally defined period of 15 (fifteen) days from the date of receipt of the complaint.
6. LEGAL NOTICES
The platform is issued by STARA PELEGRINKA, an association for sports and recreation with headquarters at Sinovčićeva 6, 21 000, Split, Croatia, represented by Damir Lastre.
